Terms of Service

These Terms govern your use of Theo AI Tutor ("Theo"), an app and website made by Green Gables Studio LLC, a Delaware limited liability company ("we", "us"). By using Theo you agree to them. Effective date: October 6, 2026.

1. Who can use Theo

You must be at least 13 years old to use Theo. Theo is not meant for children under 13, and they may not use it.

If you are under 18, or under the age of majority where you live, you may use Theo only with the permission of a parent or legal guardian. If you are a parent or guardian and you let your child use Theo, you agree to these Terms for them and are responsible for their use of Theo, including any purchases.

If we learn that someone under 13 is using Theo, we will end their use and delete their information, as our Privacy Policy describes.

2. Subscriptions and payment

Parts of Theo need a paid subscription. The price, the billing period and any free trial are shown in the app before you subscribe.

• Subscriptions are bought through Apple's App Store and charged to your Apple ID when you confirm the purchase. Apple's terms apply to the payment.
• A subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the current period ends. The renewal is charged within the 24 hours before the period ends.
• If you start a free trial, you are charged when it ends unless you cancel at least 24 hours before then. Any unused part of a free trial ends when you buy a subscription.
• You can manage or cancel your subscription in your Apple ID's account settings. Cancelling stops the next renewal, and you keep access until the end of the period you have paid for.
• Refunds for App Store purchases are handled by Apple under its policies. We cannot issue them ourselves.
• If the price changes, Apple tells you in advance as its rules require, and you can cancel before the new price applies.

3. Your photos and content

Theo works from what you give it: photographs of the problems you want help with, and of your own handwritten answers. You keep whatever rights you have in them.

So that Theo can teach you, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display your photos and what Theo reads from them, in order to provide Theo to you and to improve it — for example, to check and improve how accurately Theo reads handwriting and places its red-pen marks. The licence ends when your content is deleted.

Only upload content you have the right to share. Do not photograph other people, their personal information, or anything that is not your schoolwork.

The lessons, explanations and corrections Theo writes for you are yours to use for your own studying.

4. Using Theo properly

Use Theo to learn. You agree not to:

• upload anything abusive, hateful, sexual, violent or unlawful;
• upload other people's images or personal information without their permission;
• use Theo during a test or exam, or in any way your school or teacher does not allow;
• copy, sell or share Theo's lessons or content as your own product, or use them to build a competing one;
• reverse engineer the app, scrape it, overload it, get around its paywall or security, or use it through bots or scripts;
• pretend to be someone else, or give a false age.

We may remove content, and suspend or end access, if these rules are broken.

5. Lessons are written by AI

Theo's lessons, its reading of your answers and its red-pen corrections are generated by artificial intelligence, not by a human tutor. They can be wrong: an explanation can contain a mistake, and your handwriting can be misread. Check anything important with your teacher or your textbook.

Theo is a study aid. It does not replace your teacher or your school, and it does not promise any grade or result. Your schoolwork is your own: follow your school's rules on what help you may use.

6. Theo's app and content

Theo — its software, design, name and logo, and the lessons and other material in it — belongs to us or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, and the website, for your own studying, under these Terms and, for the app, the App Store's Usage Rules. We keep every right we do not expressly give you.

If you send us feedback or ideas, we may use them without owing you anything.

7. Apple App Store terms

If you got Theo from Apple's App Store, these terms also apply:

• These Terms are between you and us, not Apple. We, not Apple, are solely responsible for Theo and its content.
• Your licence to the app is a non-transferable licence to use it on Apple-branded products you own or control, as the App Store's Usage Rules allow, including through Family Sharing.
• We, not Apple, are solely responsible for maintenance and support. Apple has no obligation to provide any.
• If Theo fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for Theo.
• We, not Apple, are responsible for any claims by you or anyone else about Theo, including product liability claims, claims that Theo fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If anyone claims that Theo or your use of it infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not in a country subject to a U.S. Government embargo or designated by it as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when you use Theo, such as your wireless data plan.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

8. Changes, suspension and ending

We may change Theo — add, change or remove features — or stop offering it. If we stop offering a subscription you have paid for, we will tell you, and refunds will follow Apple's process.

We may update these Terms. When a change matters, we will tell you in the app or on our website before it takes effect. If you keep using Theo after that, you accept the new Terms; if you do not, stop using Theo and cancel your subscription.

You can stop using Theo at any time. We may suspend or end your access if you break these Terms, or where the law requires it.

9. Disclaimers and limits of liability

Theo is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Theo will be uninterrupted, free of errors, or right in every lesson.

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or any academic result, arising from your use of Theo. Our total liability for any claim about Theo is limited to the greater of what you paid for Theo in the 12 months before the claim and US$50.

Some places do not allow these limits, so some of them may not apply to you.

10. Governing law, disputes and general terms

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. If you have a problem with Theo, please contact us first so we can try to resolve it. Any dispute we cannot resolve will be decided in the state or federal courts located in Delaware, and you and we agree to their jurisdiction, unless the law where you live gives you the right to bring it elsewhere.

These Terms, together with our Privacy Policy, are the whole agreement between you and us about Theo. If any part of them cannot be enforced, the rest still applies. If we do not enforce a part of them, we have not given up the right to do so later. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of our business.
